Site Usage Agreement

The LAB (Little American Business) mission is to support local entrepreneurial business and emerging artists, artisans and musicians via allowing temporary use on the property of the LAB Anti-Mall at 2930 Bristol St., Costa Mesa, independently and/or as part of a larger planned Special Event. We encourage engagement with the public to promote and educate the community on the local evolving world of art, music and fashion.

LICENSING AND PERMITTING

Responsible Party is responsible for obtaining their own Promoters Business License, Sellers Permit, Food Permits, or any other legal documentation as required by the City of Costa Mesa and Orange County.

PROMOTION

Any promotional materials bearing the logo or ID of The LAB must be approved in writing BEFORE public distribution. Responsible Party agrees to post a social post within 2 weeks preceding the Event, tagging @thelabantimall & geo-tagging The LAB Anti-Mall on all promo materials. Responsible Party agrees to name The LAB as host on all Event promotional pages.

Likewise, the LAB can help promote Parties’ product/service via Facebook, Instagram, eblast, etc. Please send any digital promotional materials you have to arts@thelab.com.

CONDUCT

Responsible Party shall make all efforts to maintain the cleanliness of The LAB and leave in same condition as found. It is also understood all lights and any equipment utilizing electricity will be turned off at the conclusion of any Event or use.

Responsible Party shall conduct themselves in a professional manner and shall not engage in conduct which may constitute a nuisance to, or interfere with, the tenants or customers of The LAB. Failure to do so will constitute a breach of this Agreement and be basis for immediate termination & removal at the sole discretion of the LAB Representative. The LAB is a family friendly environment.

Responsible Party agrees that The LAB shall not be liable for any damage or liability of any kind, for any injury to any persons, or any cause whatsoever resulting from the use, occupation or enjoyment of The LAB as a result of said Event. Responsible Party hereby further agrees to defend, indemnify and save harmless The LAB & its staff from all liability whatsoever including, without limitation, liability for any real or claimed damage or injury and from all liens, claims and demands arising out of the use of The LAB common areas by Responsible Party. The foregoing obligation of Responsible Party to indemnify shall survive the expiration or earlier termination of this Agreement and shall include all costs of legal counsel and investigation, and other costs and liabilities incurred in connection with any and all claims of damage.

The LAB offers no reimbursement for damaged or stolen artwork or property before, during or after Event and relies on the Responsible Party for full responsibility, care and supervision of their belongings.

If any specific provision of this Agreement becomes invalid or unenforceable for any reason, then all other provisions of this Agreement shall remain in full force and effect. This constitutes the entire Agreement between the parties and any modifications made to the Agreement after signing shall be in writing and incorporated into the Agreement by reference.

PAYMENT

Responsible Party agrees to pay a non-refundable fee of $20 in order to participate in and hold a spot for this Mart.

We appreciate the courtesy of a 7-day advance notice for any unforeseen cancellation.

ACCESSING THE SPACE

The LAB representative will advise location for said Event and set up and tear down times for Event.

CLEANING

The space is rented in “as-is” condition and should be returned in the condition received.
